1. Acceptance of these Terms
By accessing or using the Service you (“you” or “User”) agree to be bound by these Terms and our Privacy Policy. You also acknowledge our Responsible Gambling policy, which is incorporated by reference.
You may only use the Service if you can form a binding contract with us, and only in compliance with these Terms and all applicable local, state, national, and international laws, rules, and regulations.
2. Eligibility
To use the Service you represent and warrant that you:
- are at least 21 years of age;
- have the legal capacity to enter into these Terms;
- are not located in, under the control of, or a national or resident of any jurisdiction where use of the Service would violate applicable law;
- have not been previously banned, suspended, or removed from the Service;
- are not on any U.S. or other government list of prohibited or restricted parties.
Sports wagering is regulated differently across jurisdictions. You are solely responsible for determining whether your use of the Service, and any wagering you choose to engage in with third-party sportsbooks based on information from the Service, is lawful in your jurisdiction.
3. Your account
3.1 Registration
To access most features you must register for an account. You agree to provide accurate, current, and complete information and to keep it updated.
3.2 Credentials
You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately at security@evenodds.io if you suspect unauthorized use.
3.3 One account per person
You may not maintain more than one account. Account sharing, reselling, or sublicensing access is prohibited and grounds for immediate termination without refund.
4. Subscription & billing
4.1 Plans and payment
Paid plans (“Subscriptions”) are billed on a monthly or annual basis through our payment processor, Stripe, Inc. By subscribing you authorize us (through Stripe) to charge your selected payment method for all applicable fees, including taxes.
4.2 Automatic renewal
Subscriptions automatically renewat the end of each billing period unless canceled. You can cancel at any time through your account’s billing portal. Cancellation takes effect at the end of the then-current billing period; you retain access until that date.
4.3 Free trials
We may offer a free trial. Unless you cancel before the trial ends, your paid Subscription will begin automatically at the posted price. We will notify you at least three (3) days before the trial ends.
4.4 Refunds
Except where required by applicable law, all fees are non-refundable, including for partial billing periods and for features you did not use. We may issue refunds or credits at our sole discretion; issuing one does not obligate us to issue another.
4.5 Price changes
We may change Subscription prices. For active subscribers, price changes take effect no sooner than the start of the next billing period after we notify you (at least thirty (30) days in advance via email or in-app notice). Continuing to use the Service after a price change constitutes acceptance.
4.6 Taxes
You are responsible for all applicable sales, use, VAT, or similar taxes on Subscription fees, except taxes based on our net income.
5. Nature of the Service
EvenOdds is an informational and analytical tool. We aggregate publicly available odds, projections, and other data and surface our model’s opinions about potential betting edges. We are not a sportsbook. We do not accept wagers, hold funds, or facilitate the placement of bets.Any wagers you choose to place are made directly with third-party sportsbooks and are subject to their terms and your jurisdiction’s laws.
No guarantee of results. Sports betting involves substantial risk of loss. Past performance of any model, algorithm, or selection does not guarantee future results. Information provided by the Service is opinion, not advice, and should not be relied upon as the sole basis for any wagering decision.
6. Acceptable use
You agree that you will not:
- use the Service in violation of any law, including gambling, gaming, or anti-money-laundering laws;
- scrape, copy, mirror, or redistribute the Service’s data, picks, or content in any commercial or competing product;
- attempt to reverse-engineer, decompile, or otherwise derive the source code of the Service;
- interfere with, disrupt, or circumvent security features, rate limits, or access controls;
- use automated means (bots, scrapers, headless browsers) to access the Service, except as expressly permitted in writing by us;
- share your account credentials or allow any third party to use your account;
- impersonate any person or entity or misrepresent your affiliation with any person or entity;
- upload viruses, malware, or other harmful code;
- use the Service to facilitate any form of fraud, match-fixing, insider wagering, or other unlawful activity.
We reserve the right to investigate and take appropriate action, up to and including account termination, referral to law enforcement, and civil or criminal proceedings.
7. Intellectual property
7.1 Our content
The Service, including all text, graphics, logos, models, pick outputs, analytics, and software, is owned by EvenOdds or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service solely for your personal, non-commercial use, subject to these Terms.
7.2 Your content
Any feedback, suggestions, or communications you send us (“Feedback”) is non-confidential. You grant us a perpetual, irrevocable, royalty-free license to use Feedback for any purpose without compensation.
7.3 Trademarks
“EvenOdds” and our logos are our trademarks. Team names, league names, and player names referenced in the Service are the property of their respective owners and are used for identification purposes only. We are not endorsed by or affiliated with any professional sports league, team, or sportsbook.
8. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or availability.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that content is accurate; or that results from using the Service will be profitable. You use the Service at your own risk.
9. Limitation of liability
To the maximum extent permitted by law, in no event will EvenOdds or its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost wagers, lost data, or goodwill, arising out of or in connection with the Service — whether based in contract, tort, statute, or otherwise, and whether or not we have been advised of the possibility of such damages.
Our total aggregate liability to you for any and all claims arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the greatest extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless EvenOdds and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any law or third-party right; or (d) your wagering activity with any third party.
11. Termination
You may stop using the Service at any time and cancel your Subscription through your account settings. We may suspend or terminate your access immediately, without notice, if we reasonably believe you have violated these Terms, pose a risk to the Service or other users, or for any other lawful reason.
Upon termination, your right to use the Service ends. Sections 7 (Intellectual property), 8 (Disclaimers), 9 (Limitation of liability), 10 (Indemnification), 12 (Disputes), and any other provision that by its nature should survive termination will survive.
12. Disputes & arbitration
Please read this section carefully — it affects your legal rights.
12.1 Informal resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@evenodds.io. We’ll try to resolve the dispute within thirty (30) days.
12.2 Binding arbitration
If we cannot resolve the dispute informally, you and EvenOdds agree to resolve any dispute arising out of or relating to these Terms or the Service through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in the English language and held in the State of Delaware, United States, or by videoconference.
12.3 Class-action waiver
You and EvenOdds agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative action.
12.4 Opt-out
You may opt out of this arbitration agreement by emailing legal@evenodds.io within thirty (30) days of first accepting these Terms. Include your full name and account email in the message.
12.5 Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
13. Changes to these Terms
We may revise these Terms from time to time. If we make material changes, we will notify you by email or in-app notice at least thirty (30) days before they take effect (or as soon as reasonably practicable for changes required by law). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
